Operational capabilities

 

The principals of the firm are Barry Hamilton and Kiara Calvert who both hold a Certificate of Public Practice issued by the Institute of Chartered Accountants for Australia and New Zealand, are registered liquidators and trustees in bankruptcy and have extensive experience in forensic/insolvency.

 

All team members have extensive experience in reporting to regulators including the Australian Securities & Investments Commission, Australian Taxation Office, Australian Financial Services Authority and Department of Corporate Affairs.

 

The practice has an extensive background of knowledge of director’s duties and compliance with State and Federal Laws. The practice has a duty to investigate and report incorrect behaviour to regulators and this is carried out by adherence to our guidance template for identifying offences.

 

Investigation of unethical behaviour – investigating allegations of improper conduct within an organisation

 

Our procedures on all insolvency appointments are to review the books and records, seek information from creditors in order to identify inappropriate conduct and behaviour, which is then check listed to an offences template so as to identify inappropriate behaviour and offences. Evidence is collected that supports (and also does support the conclusion as appropriate), if evidence supports the conclusion a file is made up to recommend the activity be reported to the regulator.

 

Fraud investigation

 

a) Our quality assurance system includes the following:

  • Collection and identification of source material;
  • Preparation of notes for information that would be expected but not included in source material;
  • Correspondence with relevant party seeking any further information they may have;
  • Examination of material to identify offences/ behaviour issues;
  • Preparation of file notes collated to evidence; and
  • Preparation of report check listed to source information.   

 

b) Hamilton Calvert Advisory has extensive experience in identifying incorrect behaviour by directors and bankrupts resulting in well in excess of 100 reports being lodged with the relevant regulator. We have also prepared the briefs of evidence for both State and Federal Directors of Public Prosecutor for this purpose. 

 

c) With all engagements we seek to establish an understanding of the scope of work that has to be delivered then put in place suitable agreed procedures with the client for investigation meeting deadlines and reporting and ensuring compliance with the scope of work and reporting requirements.
